Tenancy Dispute Services

There are many reasons as to why an eviction is warranted some but not all include:

• Non payment of rent
• Extensive damages to the property
• Repossession
• Breach of contract
• Behavior that is putting others in danger

If the issue persists and we feel it warrants further action, a 14 day eviction notice will be issued with and backed up with a filed RTDRS hearing date that we will serve with an explanation to the tenant with instructions to attend or be present at the hearing via in person telephone hearing.

In the event we have to follow through with the hearing and a judgement has been made we will be present to ensure the client follows the order. If the tenant defaults on the order, we will coordinate with a bailiff agency to remove occupants from your premises.

The Residential Tenancy Dispute Resolution Service (RTDRS) is faster, less formal and less expensive than going to the courts. Landlords and tenants may make an application for remedies under the Residential Tenancies Act and the Mobile Home Sites Tenancies Act .

These are the services we provide in regards to evictions:

• We prepare/serve notice and complete an affidavit
• We prepare/file the application with the RTDRS, serve the tenant and represent you during the hearing. After the hearing we file the court order and serve the tenant.
• We will have a bailiff attend the rental premises, enforce your court order to evict the tenants and oversee the lock change.

Please note, the RTDRS may accept applications of up to $50,000. Applications must be made within 2 years from the date that a potential claim is discovered.
